The academic debate about law over the course of the past generation has been shaped by two schools of thought that seem to be located at opposite ends of the ideological spectrum: law and economics and critical legal studies. My primary focus here will be on law and economics, mostly because it has so thoroughly carried the day. Meanwhile, there is no area of law where CLS arguments have had substantial influence on legal doctrine. Still, CLS has had important influence on academic arguments; understanding it in Christian terms thus is worthwhile if one wishes to understand modern academic debates, particularly in public law fields. What follows is a brief discussion of CLS and a possible Christian reaction to it. The focus then shifts to law & economics.
